Tutela jurisdiccional del derecho a la salud: el caso de VIH/SIDA

Abstract

Basado en el expediente Nº 2016-2004-AA/TC, este informe jurídico desarrolla la importancia de la tutela jurisdiccional del derecho a la salud en el Perú y confronta la realidad por la que pasan las personas que han sido diagnosticadas con VIH. El caso estudiado cuenta cómo el Estado se responsabiliza del tratamiento de un paciente en la etapa de SIDA, la necesidad de mejoras que se deben dar y el largo camino que va a necesitar recorrer como demandante para acceder a una atención médica gratuita así como a un tratamiento con el que no solo va a poder continuar con su vida sino que más bien necesita para contar con una vida digna.

Based on file No. 2016-2004-AA/TC, this legal report develops the importance of jurisdictional protection of the right to health in Peru and confronts the reality that people who have been diagnosed with HIV go through. The case studied tells how the State is responsible for the treatment of a patient with AIDS, the need for improvements that must be made and the long path that will need to be taken as a plaintiff to access free medical care as well as treatment. With which he will not only be able to continue with his life but rather needs to have a dignified life.
