Ante una pandemia, mejores reglas: las modificaciones en las reglas más importantes de arbitraje internacional a raíz de la pandemia por Covid-19

Abstract

En este artículo se describen los principales cambios suscitados en el arbitraje internacional a raíz de la pandemia originada por el Covid-19. De esta manera, ambos autores analizan tanto las Reglas IBA 2020 sobre Práctica de Prueba como el Reglamento Arbitral ICC de 2021. Entre ellos destacan las materias de audiencias virtuales, ciberseguridad, el deber de revelar la identidad del tercero financiador y la incorporación de partes adicionales a un arbitraje en curso.

This article describes the main changes in international arbitration because of the pandemic caused by Covid-19. In this way, both authors analyze both the IBA 2020 Rules of Evidence and the ICC Arbitration Rules of 2021. These include the issues of virtual hearings, cybersecurity, the duty to disclose the identity of the third-party funder and the incorporation of additional parties to an ongoing arbitration.
