dc.description.abstractEn el presente artículo, José María de la Jara analiza los sesgos y heurísticas que influyen en el razonamiento del juez al momento de determinar la responsabilidad extracontractual. Específicamente, se encarga de los elementos de factor de atribución y daño, explicándolos a la luz de estudios psicológicos y además otorgando herramientas para contrarrestar los efectos negativos de los sesgos. Asimismo, reflexiona en torno a la importancia de la persuasión encubierta como una herramienta beneficiosa para los abogados y jueces.es_PE

Specifically, it deals with the elements of attribution factor and damage, explaining them in the light of psychological studies and also providing tools to counteract the negative effects of the biases. It also reflects on the importance of covert persuasion as a beneficial tool for lawyers and judges.en
